Users

Users are all Internet users who browse, read, view and use the gardel.fr website, hereinafter referred to as “Users”.

2. Privacy

Collected and processed data

In accordance with the provisions of Article 5 of European Regulation 2016/679 (RGPD), the collection and processing of site users’ data complies with the following principles:

  • Legality, fairness and transparency: data may only be collected and processed with the consent of the user who owns the data. Whenever personal data is collected, the user will be informed that his or her data is being collected, and for what purpose the data is being collected;
  • Limited purposes: data is collected and processed for one or more of the purposes set out in these general terms and conditions of use;
  • Minimization of data collection and processing: only the data necessary for the proper execution of the objectives pursued by the site are collected;
  • Limited data retention: data is retained for a limited period, of which the user is informed.
  • Integrity and confidentiality of data collected and processed: the data controller undertakes to guarantee the integrity and confidentiality of the data collected.

In order to be lawful, and in accordance with the requirements of Article 6 of the RGPD, the collection and processing of personal data may only take place if they comply with at least one of the conditions listed below:

  • The user has expressly consented to the processing ;
  • The processing is necessary for the proper performance of a contract;
  • The processing is necessary in order to safeguard the vital interests of the data subject or of another natural person;
  • The processing and collection of personal data is necessary for the purposes of the legitimate and private interests pursued by the controller.

The personal data collected on the gardel.fr website are as follows:

  • IP address: when browsing the site, for statistical purposes. This data is kept for a maximum of 12 months.
  • Name, e-mail address and telephone number: when sending a message via the site’s contact form, so that we can respond to your request.

This data is kept for a maximum of 12 months and/or upon request for deletion. Such a request may be made to dpo@gardel.fr.
The data controller will keep all data collected under optimum security conditions.

User rights

In accordance with regulations concerning the processing of personal data, the User has the rights listed below.

In order for the data controller to comply with your request, you must provide the following information: your first and last name, e-mail address and, if relevant, your customer login.

Right to data portability
Users have the right to request the portability of their personal data held by the site to another site, by sending an e-mail to dpo@gardel.fr.

Right to limit and object to the processing of data
Finally, the User has the right to request the limitation of or to object to the processing of his/her data by the site, without the site being able to refuse, unless it can demonstrate the existence of legitimate and compelling reasons, which may override the interests and rights and freedoms of the User.

Right to determine the fate of data after death
Users are reminded that they can organize what is to become of their collected and processed data if they die, in accordance with law no. 2016-1321 of October 7, 2016.

Right to refer to the competent supervisory authority
In the event that the data controller decides not to respond to the User’s request, and the User wishes to contest this decision, he/she is entitled to refer the matter to the CNIL (Commission Nationale de l’Informatique et des Libertés, https://www.cnil.fr) or any competent judge

The data controller is obliged to respond to the User within a maximum of 30 (thirty) days.

Obligations of the data controller

The data controller undertakes to protect the personal data collected, not to pass it on to third parties without the user’s knowledge, and to respect the purposes for which the data was collected.

The data controller undertakes to implement all appropriate technical and organizational measures to protect the security of personal data.

The site has an SSL certificate to guarantee that information and data transfer via the site is secure.

In addition, the data controller undertakes to notify the user of any rectification or deletion of data, unless this would entail disproportionate formalities, costs or steps.

In the event that the integrity, confidentiality or security of the User’s personal data is compromised, the data controller undertakes to inform the User by any means necessary.

Cookies

The site uses “cookies” to process statistics and traffic information. For the use of cookies involving the storage and analysis of personal data, the user’s consent must be obtained.

The User’s consent is considered valid for a maximum period of 13 (thirteen) months. At the end of this period, the site will again ask for the user’s permission to store “cookies” on his or her hard disk.

Users are informed that they may refuse to accept cookies by configuring their browser software.

Should the user decide to deactivate cookies, he/she will be able to continue browsing the site. However, any malfunction of the site caused by this manipulation cannot be considered to be the fault of the Site Editor.

3. Accessibility

In principle, the Site is accessible to Users 24 hours a day, 7 days a week, unless interrupted, whether scheduled or not, for maintenance purposes or in the event of force majeure.

Should access to the Site be impossible, the latter undertakes to do its utmost to restore access. The Site shall not be held liable for any damage whatsoever resulting from its unavailability.

4. Applicable law and jurisdiction

This Legal Notice is governed by French law. In the event of a dispute, and failing amicable agreement, the dispute will be brought before the French courts in accordance with the rules of jurisdiction in force.

The personal information provided on this form are recorded in a computer file GARDEL SA.

We will only process or use your data insofar as this is necessary to: contact you, process your requests, create and manage your user profile, create and manage your access to our online services, prepare your order lists for our products.

Your personal information will be kept for as long as necessary, for the duration of the supply of our products and services, unless :

  • You can exercise your right to delete your personal data under the conditions described below;
  • A longer retention period is authorized or imposed by law or regulation.

During this period, we take all necessary steps to ensure the confidentiality and security of your personal data, so as to prevent damage, deletion or access by unauthorized third parties.

Access to your personal data is strictly limited to our administrative staff, our communications department and, where applicable, our subcontractors.

The subcontractors in question are subject to an obligation of confidentiality and may only use your data in accordance with our contractual provisions and applicable legislation. Apart from the cases set out above,
we undertake not to sell, rent, transfer or give third parties access to your data without your prior consent, unless we are obliged to do so for a legitimate reason (legal obligation, fight against fraud or abuse, exercise of rights of defence, etc.).
